Terms and Conditions
of sales in the on-line store on the website of BONONIA ESTATE Ltd.
The present General Terms and Conditions govern the relationship between BONONIA ESTATE Ltd. and the customers of its on-line store, regulating the terms, manner and conditions of purchase and sales carried out through the on-line store. With their acceptance by the customer (buyer), they become a purchase and sale contract between BONONIA ESTATE Ltd. and the buyer.
Through its on-line store, BONONIA ESTATE Ltd. allows the purchase of the wines and other items offered through the on-line store by way of placing an order and making a payment of the relevant sales price, subject to these General Terms and Conditions. The Customer may place an order to buy the goods offered through the on-line store only after they have specified that they accept these General Terms and Conditions. By giving their consent, in the case of an order placed by them, Customers shall be bound by the clauses of the General Terms and Conditions and shall be obliged to comply with them.
BONONIA ESTATE Ltd. reserves the right to modify these General Terms and Conditions by publishing these changes on its website. Therefore, every time a Customer enters the on-line store, they must confirm that they are familiar with and accept the General Terms and Conditions. In the event of changes to the current General Terms and Conditions during the term of a contract with a Customer, BONONIA ESTATE Ltd. shall inform the Customer thereof by giving them the opportunity to state that they reject the changes by sending a message within 14 days stating that they do not accept the changes to the following e-mail address: office@bononiaestate.com. Upon receipt of the express statement of rejection, the sale and purchase contract shall be deemed to be terminated in cases where the Customer has not paid the goods. The changes to the General Terms and Conditions do not affect the relationship between the Customer and BONONIA ESTATE Ltd. which has arisen in connection with a valid request to purchase a good and a payment made prior to such changes.
1. DEFINITIONS
For the purposes of these General Terms and Conditions, the following terms shall be used with the following meanings:
BONONIA ESTATE Ltd. is a commercial company registered in the Commercial Register of the Registry Agency under UIC 201666651, having its seat and registered address at 27B SREDNA GORA Str., ZONE B-5-3 r.d., Vazrazhdane Region, 1000 Sofia, engaged in the production of wine from its own vineyards, which offers for sale self-produced wines through the on-line store on the website of BONONIA ESTATE Ltd.

A “CUSTOMER” is a natural or legal person who has placed an order in the on-line store on the website of BONONIA ESTATE Ltd. and has agreed to these General Terms and Conditions.
By placing an order, the CUSTOMER who is a natural person declares that they have completed 18 (eighteen) years of age. If you purchase wine from our website for a gift – the recipient should also be over 18 years of age. You bear responsibility for providing false information for the purpose of using the services and information on the website.
Bononia Estate Ltd. reserves the right to refuse orders placed by persons under 18 years of age and to delete any customer profiles created in breach of this requirement.
‘GOODS/ARTICLES MADE AVAILABLE THROUGH THE ON-LINE STORE’ means: wine and spirit drinks within the meaning of the Wine and Spirit Drinks Act. Each item included in the on-line store is described by its main characteristics and sales price. All prices announced in the on-line store of Bononia Estate are in Bulgarian levs with VAT charged.
A ‘PURCHASE ORDER/REQUEST’ is present upon the successful completion of the order process detailed in point 2.
‘CONSENT TO THE GENERAL TERMS AND CONDITIONS’ – by checking the relevant fields ‘I accept the General Terms and Conditions’ and/or by pressing the virtual ‘Save and Continue’ button under the words ‘By proceeding, I accept the General Terms and Conditions for rejecting an order’, or by calling the order number specified in the General Terms and Conditions, the Customer declares that they are familiar with and accept these General Terms and Conditions and that they shall be binding upon them in their dealings with BONONIA ESTATE Ltd. during the fulfilment of the order placed.
‘PAYMENT’ is present upon the successful completion of the payment process detailed in point 2.
2. PURCHASE ORDER/REQUEST:
A purchase order/request shall be placed by the Customer by fulfilling the following successive actions:
2.1. Order with registration
– REGISTRATION: Registration allows the Customer to have their own personal profile on our website (account), through which you can receive special offers and discounts. For the purposes of registration, the Customer shall provide their e-mail, select and confirm the password by which they shall be identified on the website, and accept the general terms and conditions by checking the relevant field;
– For the purposes of registration of legal persons, the Customer shall provide the following information: firm, e-mail address, UIC (by checking whether there is a VAT registration or not), accountable person, address.
– the Customer guarantees that the data provided when filling in the registration form are true, complete and accurate.
– BONONIA ESTATE Ltd. guarantees that the data are protected within the meaning of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27.04.2016.
– ORDER after registration: The customer presses the virtual ‘Login’ button, fills in both their e-mail and password, and logs in. They make their choice by indicating ‘add to the basket’ for the desired item.
2.2. Order without registration (as a guest):
– No previous registration is necessary to view the products. An order may also be placed as a guest only by filling in contact and delivery details. In this case, the Customer determines the type and quantity of the goods and confirms the request (by pressing a virtual ‘add to the basket’ button opposite the goods in question);
– the Customer fills in contact and delivery details.
2.3. Order by phone: the Customer can also make their order by calling 0885 633 092. Our operator will accept and process the request.
2.4. Invoice issuance: if the Customer wishes to be issued an invoice for the purchased products, they must, after completing the selection and reviewing the order, tick the box ‘Invoice’ and ‘I accept the General Terms and Conditions’. Otherwise, each delivery is accompanied by a cash receipt for the value of the order.
3. PAYMENT OF THE GOODS ORDERED:
The Customer shall make a payment by fulfilling the following successive steps:
– After the selection and order review is completed, you have to press the virtual ‘Pay’ button;
– You have to fill in the data on ‘Address for payment’ and ‘Address for delivery’, including names, addresses, phone number;
– You have to press the virtual ‘Save and Continue’ button under the words ‘By proceeding, I accept the General Terms and Conditions for rejecting an order’;
– You have to specify the delivery method – from the office of Bononia Estate Ltd. or through Speedy
– You have to specify the method of payment – cash on delivery, via ‘e-pay’ or by card;
– When you check ‘cash on delivery’, you receive confirmation that the order has been successfully accepted and an ‘order code’;
– When you check e-pay/card, you have to enter data on the type, number and validity of the card and CVV2/CVC2;
– You have to press the virtual ‘Pay’ button and you will receive confirmation that the payment was executed successfully.
– By accepting these General Terms and Conditions, the Customer who is a consumer within the meaning of the Consumer Protection Act (CPA) gives their consent to the advance payment of goods within the meaning of Art. 53(1) of CPA.
4. ACCEPTANCE OF THE ORDER/REQUEST
The purchase order shall be accepted by BONONIA ESTATE Ltd. by sending a message to the Customer’s e-mail address confirming that the order was received, containing details of the order number, date and time, address for delivery, method of payment and method of delivery, subject, price and value of delivery. The message states that if desired, the Customer can change or refuse it by sending a message to office@bononiaestate.com or by calling +359 2/ 421 76 46.
The request shall take effect between the parties after verifying the availability of the goods requested for purchase and after its validity has been confirmed at the phone number provided by the Customer for communication or by sending a message to the Customer’s e-mail address.
5. DELIVERY
The goods requested for purchase shall be delivered from the office of BONONIA ESTATE Ltd. at 27B Sredna Gora Str., Sofia, or to the address specified by the Customer for delivery through the courier company SPEEDY (Operator) within 1 (one) to 3 (three) working days. An operator from the office of BONONIA ESTATTE Ltd. shall contact the Customer for the purpose of specifying a convenient day for delivery.
BONONIA ESTATE Ltd. does not guarantee the availability of the ordered items. Failing to fulfill its obligations because of not having the goods ordered in stock, BONONIA ESTATE Ltd. shall notify the Customer within 1 working day of receipt of the request that the goods are out of stock by calling the phone number provided with the order or by sending a message to the e-mail address provided by the Customer, and shall restore the value of the item(s) ordered or change the order at the Customer’s request.
Where wines of a given year are unavailable, wines from a subsequent harvest shall be delivered. The goods shall be supplied with appropriate packaging, according to their type and transport for delivery.
The goods shall be handed over to the Customer or to a third authorized person who accepts and confirms the receipt on behalf of the Customer by signing the accompanying documents. Where the Operator cannot deliver an item because the consignee refuses to receive it or to pay it, the consignee is absent for a long period of time or is an unknown person at the address indicated, the consignee has died, the delivery address is incorrect, incomplete or non-existent, and for other objective reasons, the Operator shall inform BONONIA ESTATE Ltd. and return the item to it at its expense, and BONONIA ESTATE Ltd. shall owe payment for the service in both directions. In this case, BONONIA ESTATE Ltd. shall be released from its obligation to deliver the goods requested. A re-routing of an item already sent to a new address shall be carried out following a written order by the Customer which shall be deemed to be a declared re-delivery and the delivery costs to the new address shall be subject to payment by the Customer in accordance with the Operator’s tariffs. Goods returned to BONONIA ESTATE Ltd. for any of the above reasons can be re-delivered to the Customer in case the latter pays the delivery. If the Customer refuses to pay a new delivery and has paid the goods in advance, the Customer shall be entitled to receive back the amount already paid, less any expenses incurred by BONONIA ESTATE Ltd. for sending and returning the goods.
6. REFUSAL, RETURN AND REPLACEMENT OF PURCHASED GOODS
6.1. The customer may refuse or change the order placed by contacting us at 0885 633 092, each business day, by the end of the business day on which the order was placed, or on the following day if the order has not been sent.
6.2. Upon receipt of the item, the Customer shall examine the products and, if any of them do not correspond to the ordered ones, they shall notify the courier without delay. In this case, the courier shall contact a representative of Bononia Estate and the return of the product shall be recorded and accounted for. The return of a product shall be entirely at the expense of the Consumer, except in the case of damaged packaging or expired expiry date at the time of receipt of the item. The return of the product shall take place in the original transport packaging in which the item was received. If the Customer has paid the value of the product in advance, the amount shall be returned within 14 days of the date of delivery. Any complaints relating to particular orders and deliveries shall be accepted by e-mail at office@bononiaestate.com or by an operator at 0885 633 092.
6.3. BONONIA ESTATE Ltd. reserves the right to reject or to not accept a complaint if the same is unfounded.
7. RIGHTS OF THE CUSTOMER
7.1. A Customer who is a natural person, in their capacity as a consumer within the meaning of the Consumer Protection Act, shall have the right, without payment of compensation or penalty and without giving any reason, to withdraw from the contract concluded for the purchase of goods by returning the goods within 7 (seven) working days from the date of their receipt. If the Customer withdraws from the contract within the period referred to in the preceding sentence, they shall send a statement of withdrawal from the contract to BONONIA ESTATE Ltd. and return the goods intact. The statement of refusal shall be sent to the e-mail address sales@bononiaestate.com / office@bononiaestate.com.
7.2. The Customer shall have the right to refuse to receive the goods ordered when:
- the goods delivered do not appear to correspond to the goods ordered and this can be established by their simple inspection;
- the goods have been damaged during transportation.
7.3. Upon receipt of the goods, the Customer shall have the right to return the goods at the expense of BONONIA ESTATE Ltd. if the goods are not in conformity with what has been agreed, which could not have been established by a simple inspection of the goods.
7.4. In the above cases, the Customer shall have the right to request that the goods delivered to them be replaced at the expense of BONONIA ESTATE Ltd. with an item corresponding to the request by submitting a respective written request to BONONIA ESTATE Ltd.
8. CONFIDENTIALITY
8.1. By providing their personal data to BONONIA ESTATE Ltd., Customers give their express consent to their inclusion in the database of Bononiaestate.com, registered as a data controller within the meaning of the PDPA (Personal Data Protection Act) and give their explicit and unambiguous consent to the storage, use and processing of such data in accordance with the purposes mentioned in point 11.1.
8.2. The Customer agrees that by providing any personal or other data to Bononiaestate.com, they agree that such data may be used by the latter for the following purposes of Bononiaestate.com: (1) maintaining the Customer account, including registration of orders, sending orders, carrying out ordered services, invoicing, resolving disputes with Customers concerning their orders or considering their claims; (2) sending newsletters or periodic notifications by e-mail and SMS; (3) carrying out market research, tracking and monitoring of sales and customer/consumer behaviour.
The provisions of the acting legislation of the Republic of Bulgaria shall apply to any matters not settled herein.
These General Terms and Conditions shall be effective from 25.07.2018.
